General Protections and Adverse Action - The Employee's New Sword?


This seminar looks at Part 3-1 of the Fair Work Act 2009 (Cth) (FWA) entitled "General Protections". The Part confers on employees and others significant new rights and remedies to those which existed prior to the FWA's commencement on 1 July 2009. On their face, the provisions of Part 3-1 have the scope to be applied broadly and to support a range of actions and remedies.

Damian Sloan is the Senior Legal Counsel – Workplace Relations & Safety for the Toll Group of companies. Before joining Toll, Damian had almost 20 years experience as a lawyer in the private sector, most recently as a partner in the Workplace Relations & Safety Group at Middletons.

Damian is an Accredited Specialist in Employment & Industrial Law.

Throughout his career, Damian has acted for a broad range of clients in the Transport, Manufacturing and Insurance and Financial Services industries. Damian's experience extends across all aspects of employment law, industrial relations, occupational health and safety and equal opportunity/discrimination law, at both State and Federal level. He regularly appears before the relevant courts and tribunals.

In addition to his "day job", Damian is a lecturer in Employment Law at the University of Notre Dame, Australia.

Damian is a member of the Industrial Relations Society of NSW and the Law Society of NSW.
